{"id":1445,"date":"2015-03-20T00:00:00","date_gmt":"2015-03-19T23:00:00","guid":{"rendered":"https:\/\/bsiw.pl\/new-principles-concerning-the-enforcement-of-foreign-judgments-in-eu\/"},"modified":"2015-04-01T00:00:00","modified_gmt":"2015-03-31T22:00:00","slug":"new-principles-concerning-the-enforcement-of-foreign-judgments-in-eu","status":"publish","type":"post","link":"https:\/\/bsiw.pl\/en\/new-principles-concerning-the-enforcement-of-foreign-judgments-in-eu\/","title":{"rendered":"New principles concerning the enforcement of foreign judgments in EU"},"content":{"rendered":"<p>In 2015 new regulations of the Code of civil procedure concerning the enforcement in Poland of judgments and orders of payments, passed by a court of an EU-member state, as well as concerning settlements before such a court, has entered into force. These regulations simplify significantly the enforcement of foreign decisions and remove the formal requirements that are dispensable according to the European law.<\/p>\n<p>The new regulations concern all kinds of proceedings in European law including the judgments with European Enforcement Order, European orders of payments and judgments passed in European small claims procedures. Until now, the Polish internal regulations required the foreign decisions, enforceable in EU-states, to be additionally provided with enforcement clause in Poland. This procedure was time-consuming and made assertion of claims of unreliable debtors difficult.
