Powodem takiego rozstrzygni\u0119cia by\u0142 brak dostatecznej ochrony interes\u00f3w wierzyciela. Obecnie ochrona ta ulegnie wzmocnieniu, albowiem wierzyciel b\u0119dzie mie\u0107 mo\u017cliwo\u015b\u0107 \u017c\u0105dania zmiany podstawy wpisu hipoteki po prawomocnym zako\u0144czeniu post\u0119powania, w kt\u00f3rym udzielono zabezpieczenia.<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span style=\"font-size: 11.0pt; line-height: 150%; font-family: 'Arial',sans-serif;\">The change is aimed at adjusting the legal regulations to the judgment of the Constitutional Tribunal, which recognized the provisions currently in force as unconstitutional. The reason for such a decision was the lack of sufficient protection of the creditor&#8217;s interests.
