Sejm has passed a new Act amending several acts in the field of shield actions regarding the spread of SARS-CoV-2 virus. The Parliament made significant changes in Civil Code and Civil Procedure Code with regard to usage of real estate as a form of claim security as well as regarding execution from real estate.<\/p>\n<p>According to the newly added Article 387<sup>1<\/sup> of the Civil Code an agreement, in which a natural person undertakes to transfer the ownership of a property, which fulfills their living needs, in order to secure claims indirectly connected with performed business activity, is, always if meets upper mentioned conditions, invalid<\/p>\n<p>According to the new regulations in Civil Procedure Code in case of conducting execution from a residential unit or build-up property, which fulfill living needs of the debtor, such a real estate can be auctioned only under a condition that, the amount of the receivable accounts makes up minimum 1\/20<sup>th<\/sup> of the estimated sum.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 14th May 2020 r.
