The regulation of the European Parliament and the Council No. 2016/679, passed in April 2016, i.e. so called general regulation on personal data protection will be applied starting from May 25, 2018. It constitutes the harmonization of law concerning the data protection in the entire European Union and will replace the state law, including the Polish personal data protection act.
The aim of the Regulation it to raise the standard of personal data protection, to extend the rights of persons whose data are processed by the administrators and to adjust the law to the developed information technology.
The Regulation includes i.a. new provisions concerning the data process in the capital groups, the international data transfer and establishes the so called right to be forgotten and right to transfer and limitation of personal data process.
In case of breach of obligations of the data administrator, the Regulation provides for penalties in the amount up to 20.000.000 EUR.
