Representing one of the wronged bondholders in the case of insolvency of GetBack SA Law firm Babiaczyk, Skrocki i Wspólnicy has prepared a lawsuit for payment of damages against the State Treasury – Polish Financial Supervision Authority.
The lawsuit is based on a strategy developed by the Law firm’s litigation team, taking into account gross negligence of Polish Financial Supervision Authority in terms of controlling the issuer of bonds and entities offering those bonds on the market, which in the Law firm’s opinion justifies the liability of State Treasury for the damages incurred by the purchasers of bonds.
The above stance is justified especially by the, deeply critical of the Polish Financial Supervision Authority, report of Supreme Chamber of Control, indicating among others the violation of EU-law by delayed action to implement MIFID II directive, which protects capital market participants.
