On 2 April 2021 we obtained for one of the Firm’s clients a judgment adjudicating payment of remuneration for completed construction works in the amount exceeding PLN 850,000, plus interest and legal costs.
Our client is a joint stock company listed on the Warsaw Stock Exchange, active among others in the area of power engineering construction. The company carried out construction works for one of the largest energy concerns in Poland, including construction and reconstruction of facilities with a total value of almost PLN 20,000,000. After completion of the works, the ordering party charged contractual penalties for delay and refused to pay the last part of the remuneration.
In the course of the court proceedings the lawyers of the firm’s litigation department proved that the defendant energy concern invoked the alleged deduction of contractual penalties in a completely ineffective manner. This argumentation was fully accepted by the court, which resulted in the claim being upheld in its entirety at the first hearing, without taking evidence.
