In March 2021. The Ministry of Development, Labour and Technology has sent a draft law on family foundations for public consultation. This consultation is currently ongoing, the law is planned to be enacted in the second half of 2021 and would enter into force at the beginning of 2022. The project aims to create an effective legal mechanism for multi-generational wealth succession. The foundation is to facilitate the accumulation and protection of capital. A family foundation can be established by a natural person who will contribute to the foundation property intended for the accomplishment of its goals with a value of at least 100.000 PLN. A family foundation can also be established by several founders jointly. A natural person, irrespective of the degree of kinship with the founder, as well as a public benefit organisation may become a beneficiary. The benefits that a family business owner and his/her relatives may derive from establishing a foundation will largely depend on the tax solutions adopted, including the taxation of dividends received by the foundation, which is currently the subject of public debate.
