Our lawyers represent an investor in a dispute with a construction works contractor over withdrawal from a contract and calculation of contractual penalties by both parties.
During the course of the works the contractor pointed to alleged errors in the construction design and demanded design to be changed. The investor rejected the contractor’s request, relying on the unanimous statements of the designer and the investor’s supervision inspector that the technical solutions adopted in the design were correct. The contractor refused to carry out the works and both parties submitted declarations of withdrawal from the agreement and calculated contractual penalties.
At present our lawyers represent the investor in the process initiated by the suit of the contractor for payment of contractual penalty and in the dispute with the bank against the claim for payment under the bank guarantee granted upon the order of the contractor.
