On 16 December 2021, the Ministry of Justice published a draft law amending the Civil Code Act as regards inheritances.
The draft provides for extending the grounds for declaring an heir unworthy of inheritance by the court to include the condition of evading maintenance obligations towards the testator and limits the liability of the State Treasury and municipalities inheriting under the law for inheritance debts.
In connection with the publication of the draft, the Ombudsman spoke about the changes. He considered the proposed changes to be appropriate, and at the same time, once again, drew attention to the significant legal loophole that has existed for years concerning the issuing of several different decisions by courts confirming the acquisition of an inheritance by the same person. This issue requires systemic solutions, which are still lacking in the current legal order.
