The law firm Babiaczyk, Skrocki i Wspólnicy on behalf of one of its clients brought a case to the Regional Court in Wrocław against one of Lower Silesian housing cooperatives regarding a decrease in the value of utility premises as a result of unlawful actions and negligence of the cooperative.
Our Client has co-operative ownership right to commercial premises located in a residential and commercial building in the center of Wrocław. The building was erected by the cooperative under conditions of arbitrary construction, in breach of numerous provisions of law. Despite consistent legal actions undertaken over the years on an administrative level and numerous issued decisions of building administration bodies, the cooperative did not bring the building and the premises into the state compliant with the law.
As a result of the unlawful activity of the cooperative, the value of the right that the Law Firm’s Client served suffered a significant loss, which was confirmed by an appraisal report prepared by an independent expert. On the basis of the above, the lawyers of the Law Firm’s litigation department demanded that the Client compensate the co-operative society for the damage corresponding to the amount of diminution of the value of the right to the premises.
