On the 6th of October 2022 Sejm passed an amendment of the Law on Consumer Rights and certain other laws. The amendment implements Directive 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the supply of digital content and digital services as well as Directive 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the sale of goods.
The amendment introduces the concepts of consumer warranty and consumer guarantee into the Law on Consumer Rights and, with respect to the sale of goods to consumers, excludes the application of the Civil Code’s provisions on warranty, introducing a separate, detailed regulation in their place.
In addition, the law introduces a number of solutions aimed at protecting consumers with regard to contracts for the supply of digital content and contracts for the provision of digital services, and makes changes to the Civil Code’s provisions on warranty and guarantee.
