On 6th of August 2020 in the case No. III CZP 78/19 the Supreme Court adopted an important resolution on claims arising from violation of personal rights.
According to this resolution the court hearing the case is entitled to demand information from an entity bound by the telecommunication secrecy to verify the claimant’s claim that the act violating the personal rights was committed by the defendant in the case.
The resolution will constitute a significant facilitation for people pursuing claims in regards to violation of personal rights committed online. It is therefore undoubtedly of great practical importance and may contribute to more effective enforcement of the liability of the infringers.
