On August 28, 2023 the Local Government Appeals Board in Poznan, in accordance with the procedural position presented by lawyers of the administrative law team of the Law Firm Babiaczyk Skrocki and Partners, refused to annul the decision on the environmental conditions of the project implemented by the Client of the Law Firm as part of its development activity. The application for annulment was filed by co-owners of the neighboring property, however, the argumentation presented by them was successfully challenged by the Law Firm’s lawyers and did not meet with the recognition of the Local Government Appeals Board.
The decision in question on the environmental conditions of the project was considered to have been issued in full in accordance with both substantive and procedural law. No violations of the law were found, much less qualified violations, which are prerequisites for annulment.
