In a judgment form 10th of January 2024 the District Court in Zamość has dismissed in its entirety the lawsuit filed against the Law Firm’s Client, which included, along with the demanded interest and procedural costs, an amount exceeding 100,000 PLN.
The case revolved around a contract involving the supply and installation of equipment for apartments and holiday homes in a resort owned by the Law Firm’s Client. The plaintiff company had carried out deliveries and installations, but with defects that were not rectified. Nevertheless, it issued VAT invoices and demanded payment of the full amount of compensation under the contract.
Due to the impossibility of reaching an agreement with the contractor, the amounts covered by the VAT invoices were not paid, and after several payment reminders, the counterparty of the Law Firm’s Client initiated legal proceedings.
The analysis of the lawsuit served to the Client conducted by the lawyers of the litigation team of Babiaczyk Skrocki and Partners Law Firm enabled the formulation of procedural objections that proved to be effective. In response to the lawsuit, the expiration of claims was pointed out, which occurred despite the exchange of correspondence between the accounting departments of the company, including confirmation of accounting entries, and the insufficient documentation of claims by the plaintiff.
The Court’s panel of judges fully supported the Law Firm’s position, which resulted in the dismissal of the lawsuit and the award of reimbursement of procedural costs to the Law Firm’s Client.
