On 14th May 2020 r. Sejm has passed a new Act amending several acts in the field of shield actions regarding the spread of SARS-CoV-2 virus. The Parliament made significant changes in Civil Code and Civil Procedure Code with regard to usage of real estate as a form of claim security as well as regarding execution from real estate.
According to the newly added Article 3871 of the Civil Code an agreement, in which a natural person undertakes to transfer the ownership of a property, which fulfills their living needs, in order to secure claims indirectly connected with performed business activity, is, always if meets upper mentioned conditions, invalid
According to the new regulations in Civil Procedure Code in case of conducting execution from a residential unit or build-up property, which fulfill living needs of the debtor, such a real estate can be auctioned only under a condition that, the amount of the receivable accounts makes up minimum 1/20th of the estimated sum.
