In view of the dynamic growth of our Clients’ international business activities in many European countries, the lawyers of the public procurement law department of Babiaczyk, Skrocki i Wspólnicy are continuously expanding their competencies in order to meet the needs and expectations of our Clients. In recent months and years, we have supported them in particular in projects involving:
advising on the terms of cooperation within a consortium, on the preparation of a tender offer and on the subsequent tender procedure including an electronic auction, as well as initiating and successfully conducting an appeal procedure before the National Appeals Chamber (Krajowa Izba Odwoławcza) in a tender for the construction and equipping of a municipal facility with a bid value exceeding one billion PLN;
advising on tender procedures in Slovakia, including registration in Slovak public registers and the preparation of corporate documentation, including documentation related to the reporting of beneficial owners, in cooperation with a Slovak law firm;
advising on a subcontracting agreement and on securing claims for payment of remuneration as well as on the legal relationships between the subcontractor and the contracting authority in a tender procedure in Croatia with a contract value of several dozen million euros;
successfully challenging a negative tender outcome and securing for the Client a contract worth over 10 million PLN by eliminating a competitor’s offer as a result of a ruling of the National Appeals Chamber (Krajowa Izba Odwoławcza), subsequently upheld by the court.
