By the Act of 13 April 2018, the Sejm made significant changes to the Civil Code in the scope of provisions regulating the limitation of claims.
According to the amendment, it will be impossible in principle to claim outdated claims if they are due to consumers. The court will dismiss the claim for such a claim also if the defendant does not plead the limitation period, unless special circumstances prevent it.
The basic limitation period will also be reduced from ten to six years. However, the limitation will take place at the end of the calendar year, except for periods of less than two years.
