On the basis of a judgment issued by of the Regional Court in Warsaw, which adjudicated an amount of over one million zlotys for our firm’s Client from OBI markets chain, on 14 May 2014 Głos Wielkopolski daily published an article on so called “listing fees”.
This publication raised the issue of retail chains forcing goods suppliers to pay for fictitious marketing services and promotion, which in fact was an act of unfair competition consisting in collecting fees for accepting goods for resale other than the mark-up.
Information on the rationale and the method of seeking reimbursement of costs unfairly incurred by the supplier was provided by the partner of our Firm, dr Mirosław Babiaczyk, and Bogumiła Opielewicz, a solicitor, who were involved in the lawsuit with the OBI chain.
