The lawyers of the public procurement law department of Babiaczyk, Skrocki i Wspólnicy are once again supporting the Firm’s Clients in their growth on the European public procurement market. A group of German and Polish companies is participating in a procedure conducted under Czech law, in which the contracting authority is an entity providing municipal services in Prague, namely Pražské služby a.s. The subject-matter of the contract is the construction and outfitting, including the machinery park, of a modern municipal waste processing plant.
The participation of the Firm’s Clients in a public procurement procedure in the Czech Republic requires the preparation of tender documentation requested by the contracting authority in accordance with Czech law, including documents containing information and confirmation of the legal status, competences, qualifications and experience of the Polish and German entities. The documents that, under Polish and German law, can legally be obtained in respect of commercial companies and the specialists in various technical fields employed by them are not compatible with the requirements arising under Czech law. As a consequence, it is necessary to submit extensive explanations referring to European Union law and to the differences between the above-mentioned legal systems.
