On June 12, 2023, a favorable judgment was rendered for the Law Firm’s client in a case for the payment of damages in connection with the performance of a contract to act as a contract engineer.
The Law Firm’s client is a company belonging to a group of companies listed on the Warsaw Stock Exchange, which conducts real estate development activities and previously also provided consulting and services to investors. The Company acted as a contract engineer in connection with the construction of a hotel facility. The investor accused the Company of improper contract performance and filed a lawsuit for damages of more than PLN 3,300,000, making total claims of more than PLN 9,000,000.
In the course of many years of litigation involving thousands of pages of documentation, testimonies of more than a dozen witnesses, and expert opinions, the lawyers of the firm’s litigation team led to the dismissal of the lawsuit in its entirety by successfully demonstrating the groundlessness of all charges against the Company and proving that the contract concluded with the investor was performed by the Company in a fully proper manner. On the procedural ground, it had also previously succeeded in having the court’s injunctive relief granted revoked.
Including interest and legal costs, the value of the dismissed claim exceeds PLN 5,000,000.
