On 29 March 2021 we obtained for one of the Firm’s Clients a court decision fully taking into account its interests in a case concerning the abolition of co-ownership of real estate and settlement of outlays amounting to over PLN 250,000.
A client commissioned the Law Firm to prepare and file an appeal against an unfavourable decision of the court of first instance, ordering the client to pay half of the value of a developed real estate, without taking into account expenditures made solely by the client on construction of a building on common land.
The appeal drawn up by the lawyers from the firm’s litigation department demonstrated gross violations of procedural law by the court of first instance, resulting in an erroneous determination of the facts. Consequently, the appeal was upheld in its entirety, allowing the Client to retain sole ownership of the real estate, against payment of only an undisputed half of the land purchase price.
