Law firm Babiaczyk, Skrocki i Wspólnicy while representing a Client – a company belonging to an international capital group running a production plant – acquired a favourable administrative decision exempting the Client form the obligation of payment of over 3.000.000 PLN as a restitution for the cut down of the trees.
Law firm’s Client obtained a consent to cut down a few hundreds of trees in regards to the ongoing expansion of the production plant, provided that a substitute trees will be planted. These planting were made, however the Client was charged with a fee as a result of the trees dying. During the conducted administrative proceeding, which included an opinion of a expert dendrologist, the lawyers of the firm proved that the death of the trees occurred from reasons beyond Client’s control, which allowed for him to be exempted from payment of the fee.
