On the 18th of March 2022 the Regional Court in Bydgoszcz issued a judgment favourable for the Law Firm’s Client in a case regarding deprivation of enforcement title.
The Law Firm Babiaczyk, Skrocki i Wspólnicy representing a Client – a company from the construction sector listed on the Warsaw Stock Exchange – in a case for payment of remuneration for performed construction works, obtained a final judgment awarding the whole of the claimed amount and then, due to the refusal to settle the amount due voluntarily, sent the case for bailiff enforcement. The defendant refused to pay, citing a declaration of deduction of contractual penalties, and brought an action for depriving the executive title of its enforceability, subsequently changing the action to a claim for payment for the return of more than PLN 1,000,000 of enforced funds, after the Law Firm had successfully carried out enforcement of the entire amount due from the bank account.
At the first hearing, the Regional Court shared all the arguments raised by the Law Firm with regard to the Plaintiff’s failure to cite necessary evidence already in the statement of claim, and in light of the rule of evidence preclusion binding in commercial proceedings, dismissed the action, awarding the Law Firm’s Client the reimbursement of the incurred proceedings costs.
