The turn of 2022 and 2023 brought with it a number of changes concerning consumer rights, related to the transposition of EU directives into Polish law. Indeed, as of January 1st 2023 two Acts amending the Consumer Rights Act, as well as the Civil Code, the Private International Law Act and other normative acts enter into force.
The aforementioned laws implement Directive 2019/2161 of the European Parliament and of the Council (EU) of November 27, 2019 with regard to better enforcement and modernization of EU consumer protection laws, Directive 2019/770 of the European Parliament and of the Council (EU) of May 20, 2019 on certain aspects of contracts for the supply of digital content and services, and Directive 2019/771 of the European Parliament and of the Council (EU) of May 20, 2019 on certain aspects of contracts for the sale of goods.
Among a number of changes are, in particular, the separate regulation of the seller’s liability for non-conformity of goods with the contract (in addition to the warranty regime), the shortening of the time limit for the mandatory response to a complaint, the obligation to inform about individual price adjustments on the basis of automated decision-making, if the trader uses such, and the prohibition of so-called “false promotions,” through the obligation to provide information about the lowest price of this good or this service that was in effect during the 30-day period before the introduction of the reduction – in each case of informing about the reduction.
