On January 12, 2023 The Provincial Administrative Court in Poznań recognized in full the arguments raised by the Firm’s lawyers and dismissed the complaint against the construction permit held by the Firm’s client, brought by a housing community.
The Law Firm’s client carries out development projects involving the construction and sale of units in multi-family buildings. On one of the projects, in order to implement the next stage of the project, the Client obtained a permit to convert a conflicting overhead high-voltage power line into an underground line. The line runs through the property of a neighboring residential community, and this property is affected by the permit, and the Client has demonstrated legal title to the land for construction purposes through consents granted by the purchasers of the apartments in notarial deeds.
The community objected to the reconstruction of the line and challenged the permit decision to the Provincial Administrative Court, alleging, among other things, that the aforementioned provisions of the notarial deeds were ineffective. However, the court did not share this argument and upheld the decision in its entirety.
