The sale of one of the best known and largest shopping centres in Poznań – Galeria Malta – was finalised with the participation of lawyers from Babiaczyk, Skrocki i Wspólnicy. The law firm’s team successfully represented the current owner throughout the entire negotiation process and during the signing of the preliminary and final agreement. The amount of the transaction remains a trade secret of the parties to the agreement. The activities of the Law Firm’s lawyers in the above-mentioned transaction included, in particular, participation in the due diligence process conducted by the buyer of the real estate, obtaining a favourable individual interpretation of the tax law provisions as regards the taxation of the sale of the real estate with VAT and drafting and negotiating the preliminary agreement and the final sale agreement. Along with the purchase of the property, the new owner of the facility also took over from the seller all existing lease agreements with entities operating in the Galeria Malta.
