On 13th of February 2024, the proceedings pending before the Commercial Arbitration Court in Poznań, at the Greater Poland Chamber of Construction, concluded, in which a lawsuit for payment for construction works was brought against the Law Firm’s client, engaged in property development. The value of the case, along with procedural costs and demanded interest, exceeded 250,000 PLN.

On 15th of February  2024, the Law Firm received a decision from the Regional Appeal Board in Poznań, stating – in accordance with the application submitted by the lawyers of the Law Firm’s administrative law department – the invalidity of part of the decision previously issued for the Law Firm’s Client, specifying the conditions for building and land development.

On the 2nd of January 2024, the Law Firm received the judgement of the Arbitration Court at the National Chamber of Commerce in Warsaw, fully granting the eviction lawsuit filed The Law Firm’s client is a shopping mall owner. In connection with a dispute that arose against the background of unpaid rent and other charges provided for in the contract with the tenant, the Law Firm’s client terminated the lease agreement in its entirety and demanded that the premises be vacated and surrendered. The tenant disputed the Law Firm’s Client’s position and refused to comply with the demand.

In a judgment form 10th of  January 2024 the District Court in Zamość has dismissed in its entirety the lawsuit filed against the Law Firm’s Client, which included, along with the demanded interest and procedural costs, an amount exceeding 100,000 PLN.

Another success of the Litigation and Dispute Law Department of the Law Firm Babiaczyk, Skrocki and Partners ended the proceedings conducted before the District Court Poznań – Stare Miasto in Poznań. On December 5, 2023, a verdict was issued, in which the lawsuit filed against the Law Firm’s client for remuneration resulting from the proper performance of a construction contract was dismissed in its entirety.

In July 2023, the lawyers of Babiaczyk, Skrocki and Partners drew up and filed a lawsuit on behalf of the Firm’s Client in the Regional Court in Krakow for payment of more than EUR 1,500,000, plus interest for delay and litigation costs. The claims are based on the execution and handover by the Law Firm’s Client of the object that is the subject of the construction contract, which includes a complex of warehouse, production and service buildings, as well as the establishment of contractual securities and the provision of documentation required by the client. The total value of the subject matter of the entire contract exceeded EUR 30,000,000.
