On July 24, 2023. The Provincial Inspector of Construction Supervision, as a result of an appeal filed by lawyers of the administrative law team on behalf of the Law Firm’s Client, issued a decision revoking in full the earlier decision of the District Inspector of Construction Supervision ordering the demolition of a building under construction and discontinuing the administrative proceedings. Such a decision is final in the administrative course of instances.
In July 2023, a tender was resolved in favor of the Law Firm’s Client, the subject of which was the preparation of comprehensive documentation in the nature of a feasibility study, describing the possibility and method of construction and implementation into operation of a system for the production, storage and refueling of hydrogen using a photovoltaic installation.
On November 3rd 2023, a trial in which lawyers from the litigation and insurance law teams represented the Law Firm’s Client in a dispute over the payment of Auto Casco insurance compensation for the theft of a car ended before the District Court in Poznan.
On October 17th 2023 the National Board of Appeals at the President of the Public Procurement Office issued a judgment dismissing in full the appeal of a competing contractor to the Law Firm’s Client in the tender won by the latter.
On August 28, 2023 the Local Government Appeals Board in Poznan, in accordance with the procedural position presented by lawyers of the administrative law team of the Law Firm Babiaczyk Skrocki and Partners, refused to annul the decision on the environmental conditions of the project implemented by the Client of the Law Firm as part of its development activity. The application for annulment was filed by co-owners of the neighboring property, however, the argumentation presented by them was successfully challenged by the Law Firm’s lawyers and did not meet with the recognition of the Local Government Appeals Board.
On 3rd of October 2023, in the case conducted under the reference III CZP 22/23, the Supreme Court adopted a resolution, according to which the provision of Article 448 § 1 of the Civil Code applies, in accordance with the disposition of the provision of Article 43 of the Civil Code, also to legal entities.
