On August 23 the Local Government Board of Appeals in Poznań, as a result of an appeal prepared and filed by lawyers of the administrative law team of Babiaczyk Skrocki and Partners, overruled in its entirety the earlier decision of the Mayor of Poznań refusing to change the previously issued final decision establishing the conditions of land development and at the same time changed the decision in the manner requested by the Law Firm on behalf of the Client.
On June 14, 2023 the Supreme Court of 7 judges adopted a resolution, according to which the declaration of bankruptcy of a debtor does not result in the loss of a creditor’s legitimacy to bring an action to declare a legal act of the debtor ineffective under the provision of Article 527 of the Civil Code, the so-called actio Pauliana.
On June 16, 2023, a favorable judgment was rendered for the Firm’s client in a case for payment of remuneration under a construction contract. The claims, together with costs and interest, exceeded PLN 400,000.
On July 4, 2023, the Constitutional Court ruled that Article 1a (1) (2) of the Law on Local Taxes and Fees is unconstitutional and determined that it will cease to be effective 18 months after the judgment is published in the Dziennik Ustaw of the Republic of Poland.
On June 17, 2023, a team composed of Dr. Miroslaw Babiaczyk and attorney Filip Nowakowski took part in the IX National Sailing Regatta named after Henryk Strzelecki for the Cup of the Dean of the District Chamber of Attorenys-at-law in Poznan.
On June 12, 2023, a favorable judgment was rendered for the Law Firm’s client in a case for the payment of damages in connection with the performance of a contract to act as a contract engineer.
