On January 12, 2023 The Provincial Administrative Court in Poznań recognized in full the arguments raised by the Firm’s lawyers and dismissed the complaint against the construction permit held by the Firm’s client, brought by a housing community.
On December 13th 2022 in the case no. I NSNc 433/21 the Supreme Court – Chamber or Extraordinary Control and Public Affairs issued a judgment dismissing the Prosecutor General’s extraordinary complaint against the judgment partially dismissing a lawsuit filed against the members of the management board of a limited liability company by an employee who had previously obtained a judgment awarding him a salary from the company, but which he was unable to enforce due to the company’s insolvency.
The turn of 2022 and 2023 brought with it a number of changes concerning consumer rights, related to the transposition of EU directives into Polish law. Indeed, as of January 1st 2023 two Acts amending the Consumer Rights Act, as well as the Civil Code, the Private International Law Act and other normative acts enter into force.
On November 17, 2022, in the case numbered III PZP 2/21, the Supreme Court adopted a resolution, according to which a court recognizing a case may independently disregard a provision of a law that it deems inconsistent with the Constitution of the Republic of Poland and not apply it, if the provision of Article 59(1) of the Law on the Organization and Procedure before the Constitutional Court stands in the way of a request to the Constitutional Court under Article 193 of the Constitution of the Republic of Poland. This is particularly the case when there is a need to apply to a given state of facts a provision that has already expired.
On 6th of October Sejm passed the Law on Amending Laws to Counter Usury. The law amends the Civil Code, the Code of Civil Procedure, the Criminal Code, the Banking Law and other legislation to better protect borrowers.
On October 28, 2022, with the participation of lawyers from the litigation department of the law firm Babiaczyk, Skrocki and Partners, an out-of-court settlement was concluded between the Firm’s Client and its contractor.
